AGITATIONAL MEASURES AND PEN DOWN / TOOL DOWN STRIKE.

Comrades,
                        An emergency Executive Committee meeting convened today the 30th August, 2011 at Bhujal Bhawan, Faridabad on the subject matter.  After having lengthy debate, the CEC has come to the conclusion that a prolonged and sustainable agitational measures, necessarily be undertaken so as to withdraw suspension orders in respect of S/Sh. Yashwant Singh, Chairman and Sh. L. C. Shukla, General Secretary, BEC, Varanasi and cancel the transfer orders while violating the Approved Transfer norms.

                        A notice to that effect has been served to the Chairman, CGWB informing the decision of the aforesaid meeting of the Central Executive Committee.  It is therefore advised to all the General Secretaries to mobilize the employees and implement the programme as per Annexure attached.

                        Daily report of participants may also be forwarded to Central Executive Committee and on completion of each spell of programme may also be faxed to the Chairman, CGWB, Faridabad, Secretary, MoWR, Joint Secretary, MoWR, New Delhi, Director (Admn) CGWB with the intimation to CEC.

Dear comrades, Red salute.
It is the need of time for showing our strength & unity to curb the atrocities of immatured Officers of the Board. It is in a planned manner that the officers of the Board are attacking the employees Association . Such an activity has been smelled by the Association and a precautionary measures have been taken and countered suitably/ effectively. Therefore the officers were waiting for an opportunity for right time. This is the time, the officers selected when elections held and new body taken over while winding up by former Secretary General and preparing to take full charge by successor. This intermediate time suited for them to attack Employees Association. But the All India CGWB Employees Association has been underestimated and it will be hard for them to bear with by such officers of Central Ground Water Board.

The whole episode might have been narrated by the Secretary General and Organizing Secretary through their references. Since inception of taking over by the present Executive Engineer ,the AAO and Sh S.N. Singh remained dominated and trying to dictate terms to the Assn being Executive Engineer in position is a man of empty pot.

The Head Quarter bosses are also anti associationists and wanted an opportunity to show their anger towards the Association and Employees. It is the  Association which in tern don’t wanted any controvertion but officers want it and so curious. Why should we go back and why should we remain behind .Now it is the right time to show our unity and strength and prove as we are one. It will be the better time to teach lesson to the erring officers . Please go ahead with the programmes given by the Central Executive Committee and make the agitation a grand success .

M. K. Pandhe No More


M. K. Pandhe (Madhukar Kashinath Pandhe) (June 11, 1924 - August 20, 2011) was a Politburo member of the Communist Party of India (Marxist) from 2002 [1] and is also the General Secretary of the Centre of Indian Trade Unions (CITU), one of the largest Trade Unions in India. He breathed his last, at Ram Manohar Lohya Hospital, New Delhi at the age of 86.

Manhandling of Association Office Bearers at Division III Varanasi

Comrades,
                  On 18/8/11  afternoon the association representatives Com Yashwant Singh Chairman  and Com Lal Chand Shukla General Secretary of  Division III Varanasi  meet the Executive Engineer Shri M.S.Rathore  regarding passing of few pending bills of employees. In the meeting The AEE and AAO were also present. The Association leaders enquired about the status of Bills and asked them to pass the pending bills at the earliest.

                  In this connection the under the leadership of Executive Engineer Shri M.S.Rathore . Shri Nand  Kishore Rawath AAO and Shri S.N. Singh AEE  manhandled the Association leaders  Com Yashwant Singh Chairman and  Com Lal Chand Shukla General Secretary. In the process   Com Yashwant Singh Chairman and Com Lal Chand Shukla General  were injured and medical report was taken by the police and FIR was lodged against officers involved.  


 Its is learnt that Com Yashwant Singh Chairman  and Com Lal Chand Shukla General Secretary of  Division III Varanasi  have been kept under suspension. By RD Lucknow.  Now we have to demand withdrawal of suspension orders. The Officers involved should also be kept under  suspension.as  there continuance in office of the Government servant will prejudice the investigation, trial or any inquiry (e.g. apprehended tampering with witnesses or documents)

        The CEC of AICGWBEA strongly condemns the manhandling of Association Office Bearers at Division III Varanasi by Officers. 

         All BEC are directed to hold protest against this manhandling by holding lunch hour demonstration on 22nd / 23rd August 2011 and pass resolution   demanding action against  Executive Engineer Shri M.S.Rathore,  Shri Nand  Kishore Rawath AAO and Shri S.N.Singh AEE  of  Division III Varanasi The letter addressed to Chairman CGWB and the Copy of the resolution should  be sent to The Director (Admn)  CGWB CHQ Faridabad.,

Copy should also be marked to The Secretary General AICGWBEA and Organizing Secretary AICGWBEA    for information. Now its the time to show our unity Workers Unity Zindabad 

All CEC leaders/Departmental /Office Council Members  are directed to monitor the  lunch hour demonstration on 22nd / 23rd August 2011 in their stations  and send the report Asst Organizing Secretaries should monitor in allocated stations.

Transfer Cases

Comrade,
                 A number of transfer cases are being recommended by the BEC for the cancellation. The CEC is receiving a  request letter which  is only a formal letter and it doesn’t contain facts and figures why this transfer order should be cancelled.

          In view of this In this connection it is brought to your notice that while recommending the cancellation of the transfer orders The following guidelines are to be followed so that CEC  can take  the genuine cases. The persons visiting the CHQ for cancellation of transfer orders should be discouraged.  These information should also be useful to us while talking to the authorities. Hence,  while forwarding the application following points should be highlighted.

1)   In the body of the original representation  in variably should be endorsed  to the      Secretary General through  General Secretary of the BEC
2)  The justification should be given why this transfer order should be canceled, what       is the impact on the official work, no of posts sanctioned, no of post filled,    vacancy position in that cadre.
3)  Field stay of the individual in no of years he/she has worked outside the home                  State and no of  transfers. 
4)    How  this transfer is violating the transfer norms
5)    Any other useful justification
6)  Whether any request is pending.



All General Secretaries are requested to ensure the above guidelines are adhered to.so that CEC can take up cases.

Sub: Request for Scrapping of PFRDA Bill
Sir,


We submit this petition to bring to your kind notice certain aspects of the re-introduced PFRDA Bill which will have an extremely adverse impact on the pension and retirement benefits of the Government employees. We may also state in this connection that the contributory pension scheme will be a drain on the exchequer.
The guiding principle adopted in determining the pay package of civil servants is to spread out the wage compensation over a long period of time because of which the wages during the work tenure is low to enable pension payment on retirement. This makes the pension a ”deferred wage”, which the Supreme Court has upheld as such in their landmark judgment in the case of D.S. Nakara Vs. Union of India. As the bill does not provide implicit or explicit assurance of a minimum pension except marked based guarantee, the civil servant even after contributing huge sums to pension fund may end up with no annuity if the invested company become bankrupt or the equity market crashes. Moreover the annuity which would be the pension under the new scheme being not cost indexed will make it difficult for the pensions to make the both ends meet.
The Committee set up by the 6th CPC has concluded that the new contributory pension scheme will increase the outflow from the exchequer from Rs. 14,284 Crores to Rs. 57088 Crores by 2038. The Committee has also observed that the pension liability of the Government which was 0.5% of the GDP in 2004-05 under the defined benefit scheme is likely to decline if the same is not replaced by the contributory pension scheme as envisaged in the PFRDA bill. The Committee has ultimately recommended that the existing “Pay as you go” pension which is presently in vogue will be ideal and may be continued.
Since the new scheme is neither in the interest of the country as it increases the outflow on account of pension liability nor to the Civil Servants for it does not guarantee a minimum pension, we appeal to you kindly cause withdrawal of the PFRDA Bill from the Parliament immediately.
