Equal Pay for Equal Work

Articles 14 and 39(d)--'Equal pay for equal work'-- Concept of--Whether permissible to have two pay scales in same cadre for persons having same duties and responsibilities-?

Here are the two different views of the Apex court on the subject Equal pay for equal work principle. 

A) Randhir Singh vs Union Of India & Ors on 22 February, 1982

No doubt, equation of posts and equation of pay are matters primarily for the Executive Government and expert bodies and not for the courts, but where all things are equal that is, where all relevant considerations are the same, persons holding identical posts may not be treated differentially in the matter of their pay merely because they belong to different departments. 

 B) Secretary, Finance Department and others v. West Bengal Registration Service Association and others, 1993 Supp (1) SCC 153, which thus reads: "Ordinarily a pay structure is evolved keeping in mind several factors, e.g., 
(i) method of recruitment, (ii) level at which recruitment is made, (iii) the hierarchy of service in a given cadre, (iv) "minimum educational/technical qualifications required, (v) avenues of promotion, (vi) the nature of duties and responsibilities, (vii) the horizontal and verticle relativities with similar jobs, (viii) public dealings, (ix) satisfaction level, (x) employer's capacity to pay, etc. 

The principles relating to granting higher scale of pay on the basis of equal pay for equal work are well settled. The evaluation of duties and responsibilities of different posts and determination of the pay scales applicable to such posts and determination of parity in duties and responsibilities are complex executive functions, to be carried out by expert bodies.

Elections 2013 Guidelines

Dear Comrades,
                        The circular has been issued for conducting elections for the Branch Executive Committee for the period 2013-15. In this connection it is directed all branches should hold General Body Meeting at the earliest, before 10th of April and complete the election process by end of April 2013.
                     It is also brought to your kind notice that while conducting the GB Meetings, the General Secretary report and the audited statement of accounts should be approved by the GB Meeting, the election officer / returning officer should also be elected in the GB meeting for conducting the elections. The election officer should be a member of  BEC as far as possible,  try to have an unanimous election.     
                 While sending the report for the approval for the new BEC following should be sent so that CEC approval will be accorded.
a) Election officer report on elections with details of election & number of votes polled by each candidate and list of persons elected.
b) General Secretary report 
c) Audit report
d) List of BEC members.
e) CEC Quato if due.
f) List of new elected office bearers with their contact mobile numbers.

Agitation Deferred


Comrades,
                  The proposed agitation from 18/3/2013 against appointment of Col. M.C.Joshi as Administrative Consultant has been deferred until further notice, in view of request from official side to postpone the agitation as our request is being examined, in this connection a letter to all BEC dispatched .

                  In view of the above all branches of AICGWBEA are directed not to conduct any agitation program until further notice.

Confederation Meeting at Kolkatta

Comrades,
                  The Confederation meeting is to be held at Kolkatta from 4th May to 6th May 2013. AICGWBEA will be once again taking up the issues pertaining to our department which are common in nature  such as following. 

1) Transport Allowance to field staff.
2) Removing parity in Grade Pay  of Ministerial staff (including Stenographers) with that of Central Secretariat staff.
3)  Revision of Traveling Allowance (TA/DA) rates by 50%.
4)  MACP Anomaly  issues.
5)  Work shop staff pay scales.
6) Revision of Drivers pay scale

OBSERVE WOMEN'S DAY

            8th March is observed as International Women's Day world over. Across the world, the women are asserting their rights with the slogan 'half the sky is ours'.
            The media is full of reports on atrocities against women, even against little girls. The national capital is leading in these inhuman, insane acts against girl child and women.

            This International Women's Day may be observed so as to initiate the campaign against these evils.          


 The workers movement is to be build up, the role of women is very important in this movement to face the challenges before us.

The International Women' day which falls on 8th March is observed throughout the world. The UN theme for the International women's day 2013 is "A promise is a promise; time for action to end violence against women". This year in India, we saw a massive uprising against the atrocities on women immediately after the barbarous sexual assault on student in Delhi.  She later succumbed to the injuries suffered during the assault. 

                 Thousands of young men and women, students and common people assembled at Vijay Chowk and elsewhere in Delhi and other parts of the country demanding stringent action against the culprits besides asking the Government to make enactment to protect the women. Empowerment of women is an issue that has to be focused and taken to its logical end. There is no shortcut for that. Raising the conscious level of the society at large through sustained campaign and struggles is the only way out. It is a painstaking path, but there is no other alternative.

The brutalities against women, attempt to dispossess the women of their right to property is the outcome of the patriarchal system that has taken roots in our country. In our society today women are being portrayed as a commercial commodity an offshoot of the impact of the neo liberal economic policies where except profit nothing matters. The fight for empowerment of women, hence, cannot be separate from the struggle against finance capital driven neo-liberal economic policies.

Nation Wide Agitation Program

Comrades,
                   With reference to proposal for appointment of  Col M.C.Joshi  as Administrative Consultancy in Central Ground Water Board. The matter was discussed in the CEC meeting  held at Hyderabad on 14/2/2013 it was decided to adopt   Nation wide agitation program  to see that Col M.C.Joshi  is not appointed as Administrative Consultancy in Central Ground Water Board. The matter has been taken up with the Chairman CGWB & Secretary MOWR to drop the proposal of appointment of  Col M.C.Joshi  as Administrative Consultancy in Central Ground Water Board.

                      As you are aware that Col M.C.Joshi  was instrumental in violation of transfer norms, for his inefficiency in administration the department suffered , he has no knowledge of administration etc. CGWB does not require services of  such retired persons, as we have more talented persons in our department, his appointment serves  no good to CGWB.  As such all branches of AICGWBEA are directed to adopt following Nation Wide Agitation Program and report the day to day agitation program to CEC. A detailed letter is sent to by post.

Dear Comrade,

Sub: Support to “General Strike” proposed by the Central Trade Unions

As you are aware that the call of the trade unions and Confederation of CG Employees  had decided to reiterate its all out support to the program drawn in the National Convention of all the Central Trade Unions, held on 4th September, 2012 at Talkalora Stadium, New Delhi (Resolution No.5). It has, therefore, been decided by the AICGWBEA  CEC Meeting  to extend its fullest support to the countrywide two days “General Strike” proposed by the Central Trade Unions on 20th and 21st February, 2013 on the following demands:


1. No contractorsation of works of permanent/perennial nature of wages and benefits to the contract workers
at the same rate as available to the regular workers of the industry/establishment.
2. Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs. 10,000 linked with Cost Price Index.
3. Remove all ceilings on payment and eligibility of Bonus, Provident Fund: Increase the quantum of gratuity.
4. Assured pension for all.
5. Compulsory registration of the Trade Unions within a period of 45 days and mediate ratification of the ILO Conventions Nos.87 and 98.
6) 7th CPC to be constituted.
7) Merger of DA 

You are, therefore, advised to conduct gate meetings, demonstrations, & participate in  the  dharnas, protest rallies etc,  as decided by the local COC &  Central Trade Unions   in respect of  two days’ "General Strike" & participate in strike as per local conditions
