12.12.12 Strike

Comrade,
                The Confederation of Central Government Employees has given the call for One day Strike on 12.12.12 in connection with 15 charter of  demands. The AICGWBEA has endorsed the call of the Confederation of Central Government Employees.

              The major demands include setting up of 7th CPC, rectification of anomalies, rectification of DA formula, grant of  transport allowances for all field persons, revise tour ta/da etc.

              Comrades the base year of DA formula has been changed from 1.1.2006 to 2001 index, this 2001 index  has proved that instead of getting 175% DA   we are receiving only 72% DA. Actual prices have risen by over 200% from past 6 years. This is because of the fact that faulty DA formula and wrong calculation of  Consumer Price Index (CPI).The fixation of  ratio between wholesale prices and retail prices as 1:1.2 instead of  1:1.6 as retail prices is more than 60% of the whole sale prices and also that prices are taken from rural post offices that is 60% less than urban places. for example if prices of kilo of rice is Rs 15 as per CPI as in rural post office, actual prices is Rs 35 per kilo of rice. hence the actual DA we are denied.

             The Banks, LIC & PSU wages are revised every 5 years. Many of the allowances are not revised from past 15 years or so. even the 6th CPC pay anomalies are not rectified even after 6 years. Please click here more details

              Hence it is high time that the AICGWBEA leaders take up the issues with members by calling the General Body Meeting and explain to them about the 15 charter of demands and on 19th November serve the strike notice to Head of Office.They should also participate rallys organised by local COC.

We Demand:
1.         Appoint Seventh Pay Commission for revision of wages of Central Government Employees  from 01.01.2011.
2.         Grant merger of 50% DA to all  from 01.01.2011.
3.         Remove restrictions on Compassionate appointments on par with Railways.
4.          Revise Tour DA, Grant Transport allowance to all Field Staff.
5.          Grant Bonus equivalent to Basic + GP
6.        Regularize the Casual, Part-time, contingent employees and grant revise pro-rata wages from 1.1.2006.
7.         Revise Overtime allowance and Night Duty allowance on par with Railways.       
8.         Stop downsizing, outsourcing, Contractorisation and privatization.
9.         Grant Five promotions to all.
10.       Implement all Arbitration awards.
11.       Ensure prompt functioning of JCM at all levels.
12.       Withdraw PFRDA Bill.
13.       Stop price rise and strengthen public distribution system.
14.       Withdraw all trade union victimization.
15.       Enact laws to grant Right to Strike to Government employees.

DCM/ADCM Grade Pay Upgradation kept in Abeyance


With reference to the Court case filed by Com Ram Niwas Chaudhary President AICGWBEA in Jodhpur CAT .A letter has been written to all Executive Engineers  in this regard by the CHQ Faridabad for keeping the  letter no 23/2009  dated 4.10.12 in kept in abeyance as such the DCM/ADCM Grade Pay upgradation case  kept in abeyance vide leeter no 7-23/2009 -Eng Estt dated 23rd October sent by speed post till the court case is settled .

All concerned General Secretary's are requested to contact the Executive Engineers / Head of Office for need full.

Transport Allowance

OFFICE MEMORANDUM

Sub:- Exemption of Transport Allowance from the purview of Income Tax -Enhancement of exemption limit from Rs.800 to Rs.3200 plus D.A. thereon.

   The undersigned is directed to draw the attention of the Ministry of Finance (Department of Revenue) Central Board of Direct Taxes towards para 5.2(10) (i) at page 14 of their Circular No. 05/2011 dated 16.08.2011 wherein it has been specified that the transport allowance granted to an employee to meet his expenditure for the purpose of commuting between the place of his residence and the place of duty is exempt to the extent of Rs. 800/- per month.

   Representations are being received in the Ministry of Railways from various federations of Railways. The Federations have represented that Transport Allowance was introduced with the concept of providing financial support to the Central Government Employees who incur considerable amounts for their day-to-day travel from their residence to the work place. This had materialized based on the recommendations of the V CPC which introduced Transport Allowance in 3 slabs at the rate of Rs. 100. Rs. 400 and Rs. 800, based on the classification of the cities/towns under Urban Agglomeration Act. Further, a prerequisite was introduced to allow this facility for those who stay beyond 1 km radius from the place of work.

   A decision was taken to equate such allowance on par with normal Travelling/Daily Allowance and these amounts have also been exempted from computation of annual income and exempted from the purview of Income Tax vide Income Tax(Eighth Amendment) Rules, 1995 notified vide F.No. 142/9/95-TPL dt. 7-7-1995.

   The VI CPC, while reviewing the system of grant of Transport Allowance has recommended to enhance the same from Rs. 100 to Rs. 800, Rs. 400 to Rs. 1600 and Rs. 800 to Rs. 3200, for Pay Bands 1 to 4 respectively. The City Compensatory Allowance was Withdrawn. It was also recommended to provide the coverage of D.A. to Transport Allowance as per increase in the Consumer Price Index.

   Ministry of Finance are therefore requested to include the request of the Railways for taking due action for enhancing exemption of Transport Allowance from the purview of Income Tax from Rs. 800/- to Rs. 3200/- plus DA Thereon.
